If you were stopped for DUI conviction, uninsured auto accident, or driving without proof of insurance, you will need to file SR-22 which will serve as a proof of insurance in the next 3 years after the offense. Age Limit Laws

Delaware teenagers can start to apply for their learner stage permit once they reach 16 years of age. That learner stage permit is good for their first 6 months of driving. During those 6 months, the young driver must accumulate 50 hours of supervised driving (and 10 hours at night) before applying for an intermediate stage permit. The intermediate permit is good for another 6 months, during which the young driver cannot be on the road between the hours of 10:00 PM- 6:00 AM, and cannot have more than 1 non-family passenger in the car with them. At 17 years of age, they are eligible to apply for a full driver’s license.

Insuring your Vehicle in Delaware

Contrary to what most drivers think they know about state laws, the truth is that your insurance policy is tailored more so based on your vehicle than you, the driver. This means if your vehicle is involved in any sort of accident – even if you aren’t driving it at the time – you can be held financially responsible. For this reason, the make and model are very important facts for your insurer to know before they issue a policy out on your vehicle.

Additional Delaware Auto Insurance Laws and Requirements

All of the laws we have discussed above will make a significant impact on how high or low your monthly rates are at the end of the day. But knowing the basics of your state’s everyday traffic laws is also a helpful way to keep your insurance rates as low as possible.

Highway Safety Laws

The state of Delaware recognizes that there are certain driving behaviors which, if left unchecked, could create a potentially dangerous situation on the road. If you are pulled over and convicted of at least three of the following, you can be cited for aggressive driving in addition to: failure to obey traffic control devices, passing on the right, following too closely, driving outside traffic lanes, failure to yield, passing a stopped school bus, failure to signal, or speeding.

Aggressive Driving Yes
Cell Phones and Texting Laws Yes
Inc. Penalty for High BAC BAC 0.16
Admin. License Susp. on 1st Offense 90 days

Speed Limits and Cell Phone Use

More and more states are gradually passing bans on cell phone use while driving. Delaware is one of those states which has a primary, all-driver ban on both texting, as well as talking on a cell phone while operating a motor vehicle. Should a law enforcement official catch you doing so, they can pull you over and ticket you for that violation alone.
